Highlights

• We successfully represented Guardian Bank Limited in the Supreme Court against Bookpoint Limited, leading to dismissal of an Application to file a Petition to the Supreme Court out of time.
• We continue to advise and represent the Heineken Group, a Dutch brewing company, in connection with a disputed termination of distribution agreements in Kenya, Uganda and Tanzania by vacating an interim injunction obtained by the distributors to stop the intended termination in the 3 countries. Judgment was delivered against Heineken in 2019. The value of the dispute in the 3 countries is approximately USD 30 Million.
• We successfully advised and represented China Civil Engineering Company in a USD 1.2 M tender dispute, obtaining an ex-tempore Judgment from the High Court of Kenya.
• We successfully represented Mayfair Insurance Company in a claim filed in the High Court by Peri Formworks Scaffolding Engineering (Pty) Limited for USD 1.6 Million over a Payment guarantee issued for White Lotus Projects Limited.
• We successfully represented Scanad Kenya Limited (a subsidiary of the Global Advertising Giant WPP Scanad) and obtained a USD 2.5 M Summary Judgment against the Independent and Electoral Boundaries Commission.
• We successfully represented the Petitioner in Constitutional Petition, Robert Uri Dabaly Jimma v Kenya School of Law & Kenya National Qualifications Authority, (2021) eKLR where the Constitutional Division of the High Court allowed a Petition and ordered Kenya School of Law to admit the Petitioner into the Advocates Training Program.
• We successfully represented for StandardAero (formerly Vector Aerospace Engine Services – Atlantic Inc.), one of the world’s largest aviation maintenance, repair and overhaul providers in the recovery of an aircraft engine leased to Bonge Air Services and recovery of outstanding engine rental dues.
• We successfully acted for Elliot’s Kenya Limited and Baraka Kenya Limited in relation to intellectual property disputes with Halisi Healthy Foods and Kajiado Flour Mills Limited.
• We successfully represented Crane AB in their objection to the award of a USD 105 M money printing tender by the Central Bank of Kenya to De La Rue International Limited.
• LJA advisied and represented Zakhem International Construction in relation to opposing injunctive orders sought by Ecobank Kenya & Ecobank Nigeria Limited, restraining its group of companies located in several countries from disposing any of their assets/accounts in Kenya and as well as a mandatory injunction requiring all proceeds under a disputed agreement worth USD 52.3 M between Zakhem and Kenya Pipeline Company to be remitted to Ecobank.
