LJA Associates LLP successfully represented China Civil Engineering Construction Corporation against Capitaland East Africa Ltd (with Stanbic Bank Kenya Ltd as an Interested Party). The High Court of Kenya agreed with LJA that the bid bond worth USD 1.2 M. was fraudulently called in and proceeded to cancel the bond issued by Stanbic Bank Kenya Ltd.
We successfully represented China Civil Engineering Construction Company (CCECC), one of the world’s Top 100 Contractors, in litigation in the High Court to quash a fraudulent USD 1.2 M (approximately) call made on a bid bond guarantee that CCECC issued in favour of Capitaland East Africa Limited (a regional real estate company). We subsequently had the bid bond cancelled. We drafted the pleadings, conducted the hearing of the formal proof, obtained Judgment and successfully resisted 2 attempts by Capitaland to set aside the Judgment. Notably, we swiftly obtained an interim injunction restraining the Bank from honouring the call made by Capitaland.
